Agreement to Terms
These Terms of Service ("Terms") govern your use of the TreeShop website (treeshop.app), mobile applications, and professional land clearing services provided by FL TreeShop LLC ("TreeShop," "we," "us," or "our"), a Florida limited liability company.
By accessing our website, using our applications, or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or platforms.
Our Services
Land Clearing Services
TreeShop provides professional land clearing services throughout Central Florida, including:
- Forestry mulching and brush clearing
- Land clearing and site preparation
- Trail clearing for recreational and access purposes
- Stump grinding services
- Stormwater pond restoration and maintenance
- Invasive species removal
- Selective tree removal (DBH-based packages)
Digital Services
We also provide digital tools and platforms:
- Online estimate and proposal generation tools
- TreeShop mobile application for operators
- Educational resources and calculators
- Customer portal for project management
Service Agreement & Proposals
Estimates & Proposals
All estimates and proposals provided by TreeShop are:
- Valid for 30 days from the date of issue unless otherwise stated
- Based on information provided by the customer and visual property assessment
- Subject to change if site conditions differ from initial assessment
- Not binding until a signed service agreement is executed
Deposit Requirement
A 25% deposit is required for ALL projects. This is a zero-tolerance policy with no exceptions. The deposit:
- Secures your position on our schedule
- Is due before work is scheduled to begin
- Is subject to the cancellation policy outlined below
Pricing & Payment
Our pricing structure:
- Prices are based on DBH (Diameter at Breast Height) package selection
- Final payment is due upon project completion unless otherwise agreed
- We accept cash, check, credit card, and financing options for qualified projects
- Late payments may incur fees as specified in individual service agreements
Payment Finality & Acceptance of Work
BY SUBMITTING PAYMENT, CUSTOMER ACKNOWLEDGES AND AGREES:
- Work Acceptance: Payment of any invoice, whether partial or in full, constitutes acceptance of all work completed to date as satisfactory
- No Refunds: All payments are final. No refunds will be issued after services have been rendered
- No Chargebacks: Customer agrees not to initiate chargebacks, payment disputes, or reversals for services rendered. Initiating a chargeback after services have been performed constitutes breach of this agreement and may result in collection action for the full amount plus applicable fees
- Dispute Resolution: Any concerns about completed work must be raised within 7 days of project completion and before final payment. Once payment is received, work is deemed accepted as complete
Scope Changes
If additional work is required beyond the original scope (e.g., hidden debris, larger trees than estimated, or customer requests), we will communicate the changes and any associated costs before proceeding. Additional work requires written authorization from the customer.
Customer Responsibilities
By engaging TreeShop services, you agree to:
- Property Ownership/Authorization: Confirm you own the property or have written authorization from the property owner to perform land clearing work
- Boundary Identification: Clearly mark or identify property boundaries before work begins. TreeShop is not responsible for work performed beyond marked boundaries
- Utility Location: Contact 811 (Florida 811) to mark underground utilities before work begins. Customer is responsible for damage to unmarked utilities
- Permits: Obtain any required permits from local authorities. TreeShop can assist with permit guidance but is not responsible for permit acquisition
- Access: Provide adequate access to the work area for equipment and vehicles
- Hazard Disclosure: Disclose any known hazards, including but not limited to: septic systems, wells, underground tanks, sinkholes, or environmental concerns
- Tree Preservation: Clearly mark any trees or vegetation to be preserved
- Accurate Information: Provide accurate property information for estimates
Liability & Insurance
Our Insurance Coverage
TreeShop maintains comprehensive insurance coverage:
- General Liability Insurance
- Commercial Auto Insurance
- Equipment Insurance
Certificates of Insurance are available upon request.
Limitation of Liability
To the fullest extent permitted by Florida law:
- TreeShop's liability is limited to the contract value of services provided
- We are not liable for damage to unmarked utilities, underground structures, or irrigation systems
- We are not liable for damage resulting from inaccurate boundary markings
- We are not liable for consequential, incidental, or indirect damages
- We are not responsible for damage to neighboring properties when working within marked boundaries
Indemnification
Customer agrees to indemnify and hold harmless TreeShop, its owners, employees, and subcontractors from any claims, damages, or expenses arising from: (a) inaccurate information provided by the customer, (b) failure to obtain required permits, (c) boundary disputes with neighboring properties, or (d) undisclosed hazards on the property.
Scheduling & Cancellation
Scheduling
Project start dates are scheduled based on equipment availability and weather conditions. TreeShop reserves the right to reschedule due to inclement weather, equipment issues, or other circumstances beyond our control. We will communicate any schedule changes as soon as possible.
Cancellation Policy
Please read carefully - deposit forfeit rules apply:
- More than 7 days before scheduled start: Full refund of deposit OR reschedule at no penalty
- Within 7 days of scheduled start (cancellation): Deposit is forfeited in full. No refunds.
- Within 7 days of scheduled start (reschedule): Deposit may be applied to a rescheduled date. Rescheduled projects must be completed within 90 days of the original scheduled date or the deposit is forfeited.
- No-show on scheduled date: Deposit forfeited in full. No exceptions.
Why this policy exists: When you book a date, we turn away other customers and reserve equipment specifically for your project. Last-minute cancellations result in lost revenue that cannot be recovered.
Work Standards & Warranty
Workmanship Standards
TreeShop commits to performing all work in a professional manner consistent with industry standards for forestry mulching and land clearing. Our DBH package system clearly defines what vegetation will be cleared based on the selected package. Final results may vary based on soil conditions, weather, and existing vegetation.
Mulch & Debris
Forestry mulching leaves organic material on-site. This mulch layer is a natural byproduct of the mulching process and provides erosion control and soil enrichment. Unless debris hauling is included in your service agreement, all mulched material remains on the property.
Satisfaction Guarantee
We stand behind our work. If you are not satisfied with the completed work, please contact us within 7 days of project completion. We will review concerns and work to address any issues that fall within the original scope of work.
Website & Digital Platform Terms
Online Estimates
Estimates generated through our website tools are preliminary and based on user-provided information. These estimates are not binding quotes and may differ from final pricing after on-site assessment. Online estimates are intended for budgeting purposes only.
Intellectual Property
All content on treeshop.app, including text, images, videos, logos, and software, is the property of FL TreeShop LLC or its licensors. You may not reproduce, distribute, or create derivative works without written permission. The TreeShop name, logo, DBH Package System, and MulchingScore are trademarks of FL TreeShop LLC.
User Accounts
If you create an account on our platform, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized access.
Dispute Resolution
In the event of a dispute:
- Direct Communication: Contact us directly to discuss and resolve the issue. Most concerns can be addressed through open communication.
- Mediation: If direct resolution fails, parties agree to attempt mediation before pursuing legal action.
- Governing Law: These Terms are governed by the laws of the State of Florida. Any legal action shall be brought in the courts of Volusia County, Florida.
Changes to These Terms
TreeShop reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. For significant changes, we may provide additional notice. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
